Insurance Fraud

Insurance fraud is any act committed with the intent to fraudulently obtain payment from an insurer. One example could be the deliberate causing of an event after which a claim is made on an insurance policy. If the true facts had been known to the insurer then the policy would not have paid out. Other examples could be falsifying facts to obtain payments and exaggerating existing claims.

Domestic insurance fraud includes fraudulent claims involving both home and motor insurance. Home insurance claims can be investigated for a range of reasons including but not limited to: making exaggerated claims regarding loss, making false claims, deliberately causing damage to property or more seriously staging a false burglary in order to generate money.

We have expert fraud lawyers used to dealing with insurance fraud. This could be either domestic or commercial. With insurance fraud estimated to cost the industry over £800 million a year, more investigations are being carried out than ever before.

One particular area on the increase is prosecuting individuals accused of motor insurance fraud relating to the staging of accidents. This is commonly called ‘crash for cash’. This is where an individual is accused of deliberately causing an accident, claiming for more people than were in the car or false personal injury claims. Both individuals and ‘organised groups’ may find themselves accused of ‘crash for cash’ offences. This area of insurance fraud is particularly prevalent since the increase of personal injury claims in general over the last few years and the common use of accident management companies. Often innocent people may well be accused due to the nature of the claim and we will robustly defend those accusations. We will instruct appropriate road traffic accident investigators to counter prosecution evidence where necessary and any other relevant expert to assist the preparation of the defence case. We proactively defend cases in all circumstances.

We can also assist if you are accused of commercial insurance fraud involving theft, arson and false claims for business interruptions.
