Banking Fraud

Banking fraud is a generic term for a number of different types of fraud. The main element of this offence is the use of illegal means to obtain money, property or assets belonging to a bank or its clients.

The main types of fraud covered by this term are:

  • Mortgage fraud
  • Land banking fraud
  • Credit card fraud
  • Credit card cloning
  • Account fraud
  • LIBOR (London Inter Bank Offered Rate)/rate fixing

With any of these offences often the employees of the financial institution are said to be involved and the investigation often starts with and internal investigation and possibly disciplinary procedures. If you are made the subject of any such investigation then it is important that you seek expert advice.

The investigation can also be instigated by an outside agency such as the Financial Conduct Authority or the police. Often the City of London police investigate these matters due to their proximity to the banking community in the city and through ‘Action Fraud’ which is a vehicle for reporting fraudulent activity. At this stage individuals are likely to be invited for interviews under caution or to participate on regulatory proceedings or both. It is vital to get the right advice about this as the specialist knowledge required to deal with banking fraud is key to your defence. You need to be reassured that your lawyer has a full understanding of the banking procedures at the heart of the allegation.
